Terms and conditions

We welcome you on the site of ART-PROJE LLC (hereinafter – Company).

These Rules of Use of the Site https://artproje.az (hereinafter – Rules and Site) are concluded between the Visitor of the Site (hereinafter – the User) and the Company and regulate the ways of using the Site of the Company, all information which is available on the Site, all products and services, which the Company provides through the Site (hereinafter – Services).

1. General provisions

By using the Site or any part thereof, the User automatically gives full and unconditional consent to all terms of the Company Rules and assumes the obligations in accordance with these Rules.
If the User does not agree to the terms of the Rules (in whole or in part), he should leave the Site immediately. Use of the Site, any information on the Site and use of the Services of the Site in such a case are prohibited.
If the law of the country of residence or residence, for any reason, prohibits or restricts the use of the Site, the User should refrain from visiting it. Any use of the Site in such a situation is the responsibility of the User, and these Rules shall remain in force.
The information published on the Site in the form of news, articles, descriptions of products and services and other informational materials of the Company is up to date. With the passage of time or subsequent events, some of this information may not be complete or relevant. Once published on the Site, the Company does not guarantee that such information will be promptly corrected.
The opinion of the authors of articles, news, comments and reviews, which are posted on the Site, may not coincide with the opinion and position of the Company.
Applications, proposals and claims of natural and legal persons to the Company in connection with the Rules, all questions related to the operation of the Site related to the rights and interests of third parties in its use can be sent to tender@artproje.az.
The right to use the Company’s trade name, trademarks, domain names and other distinguishing marks may be granted only by written agreement with the Company.
These Regulations may be amended and/or supplemented unilaterally by the Company without any special notice.

The Company recommends that Users regularly check the terms of these Rules for changes and/or additions. Continuation of the use of the Site by the User after the introduction of changes and/or additions to these Rules means acceptance and consent of the User with such changes and/or additions.

2. Rights, duties and responsibilities of Parties

The User undertakes to use the Site exclusively for purposes that do not contradict the Privacy Policy of the Company, these Rules, other Company Policies, the legislation in force in Ukraine, as well as the principles of reasonableness, good faith and morality.
The user is obliged to specify and place on the Site reliable information, as well as reliable, complete and up-to-date personal data.
If the User believes that the site contains information that violates his rights, he should send a message to the tender@artproje.az e-mail address and provide all information confirming that his rights have been violated.
In the event that the User has provided false information about the violation of his rights, he shall be fully liable for the damage caused and the costs incurred.
Users are prohibited from using the Site:

Misrepresent themselves or their relationship with other persons or organizations;
Use any computer programs to collect information on the Site and/or interact with the Site and its services
Unlawfully collect, organize, store and disseminate other users’ personal data
Carry out actions aimed at the disruption of the normal functioning of the Site and its services, as well as at the disruption of the functionality of computer equipment and software
Download, store, publish, distribute and provide access or otherwise use viruses, trojans and other malware
Download, store, publish, disseminate and provide access or otherwise use any information that:
Illegal or contrary to Company Rules and Policies
Calls for violation of the order established by the Constitution of Ukraine and the laws of Ukraine
Contains obscene expressions, even using masking symbols, for example, «*».
Contains threats and intimidation
Distributes unwanted email, spam
Has no meaning
Misleads other Users
Contains materials of an advertising, pornographic, erotic nature
Threatens, denigrates, insults, denigrates honour and dignity or business reputation or violates the privacy of other Users or third parties;
Contains extremist material;
Promotes criminal activity or provides advice, instructions or guidance on the commission of criminal acts;
Violates other rights and interests of natural and legal persons or requirements of Ukrainian legislation.
Posting of any other information which in the opinion of the Company is undesirable, does not correspond to the purposes of creation of the Site, infringes the interests of Users or for other reasons is undesirable for posting on the Site.
Reproduce, duplicate, copy, sell and resell the Services for any purpose, unless such action has been expressly authorized by the User under the terms of a separate agreement with the Company.

6. The User is personally responsible for any information that is posted on the Site, informs the Company and/or other Users.

7. Rights of the Company: 7.1 In case the User places information on the Site or performs other actions which are contrary to the terms of the Regulations or in respect of which it is difficult to determine conformity with the Regulations and/or the legislation in force, the Company has the right without notice, at its discretion to delete all or part of the information placed by the User. 7.2. The Company has the right to restrict the functionality of the Site, close access to it, and modify the Site in whole or in part without prior notice to the User.

8. Liability of the Company: 8.1. The Company is not responsible for the use or non-use of the Site by the User, including the impossibility of using the Site. 8.2. The Company has no obligation to verify, control and modify the information which has been placed by the User on the Site, as well as for its validity and legality.

8.3. The Company is not responsible for the content of the sites that may be linked to the Company’s Website, nor does it guarantee their availability or proper operation.

3. Intellectual property rights

All objects that are placed on the Company’s Website, including elements of design, text, graphics, illustrations, audio and video, programs, scripts and other objects and their combinations (hereinafter – Content) are subject to the exclusive rights of the Company and other rights holders.
Except in the cases established by these Rules and by the legislation in force in Ukraine, Content may not be copied (reproduced), reworked, distributed, published or transmitted, sold or otherwise used in whole or in parts without prior permission of the right holder, unless the right holder expressly expressed his consent to use the Content by the User.
The use of Content by the User is permitted solely for non-commercial use, provided that in each individual case the use of Content from the Site retains all the authorship marks (copyrights), inserts a hyperlink to the Site https://artproje.az, keeping the author’s name unchanged, saving Content unchanged.
The User, by posting on the Site the legally owned Content, gives other users non-exclusive right to use it by viewing, reproducing (including copying), reprocessing and other rights, unless such use causes or is likely to cause harm to the legitimate interests of the right holder.
The User is personally responsible for any Content and/or other information he publishes on or through the Site, as well as for the use of Content and/or any information from the Site.
By posting his Content on the Site, the User automatically grants the Company non-exclusive right to use it by copying, reproducing, publicly displaying, adapting, translating and distributing it for the purposes of the Site, including for its promotion.
The user has the right to publish his own Content.
By posting on the Site any information that contains objects of intellectual property, the User guarantees that this does not infringe copyrights and other rights of third parties.
These Rules do not give the User any exclusive proprietary rights over any of the Company’s intellectual property or any third parties unless otherwise expressly stated, that is, all ownership of such facilities is reserved exclusively to the Company and/or to the relevant third parties.

4. Third-party sites and content

The site may contain links to other Internet sites (hereinafter referred to as third-party sites), as well as articles, photos, illustrations, graphics, audio and video, information, applications, programs and other Content owned or originating from third parties (Third-party content), which is the result of intellectual activity and is in accordance with and protected by Ukrainian law.
The Company is not responsible for any information that is placed on the websites of third parties to which the User accesses through the Site or through Third Party Content, including any opinions or remarks on the websites of third parties or in Third Party Content.
The reference to any site, product, service, any information of a commercial or non-commercial nature which is placed on the Site does not constitute the approval or recommendation of these products/services by the Company.
If the User decides to leave the Site and go to third-party sites and/or use or install third-party programs, he will do so at his own risk. From now on, these Rules no longer apply to the User, and he should be guided by the rules and policies of third-party sites.
